Null and Void: High Court Quashes Appointment of NMS Transport Authority Board Members

High Court has quashed the appointment of Nairobi Metropolitan Services on Transport Authority Board members Mary Chege, Zachariah Mungai and Ronald Ndegwa.

Null and void

In a ruling on Tuesday, September 21, the court termed the appointment of the three unconstitutional.

The three were appointed by the Transport Cabinet Secretary (CS) James Macharia.

In a Gazette notice dated February 5, Macharia stated the tri was to serve for three years.

Macharia said the board was to steer operations of the Nairobi Metropolitan Area Transport Authority.

"In exercise of the powers conferred in paragraph 8 (2) of the Nairobi Metropolitan Authority Order, 2012, the Nairobi Metropolitan Council appoints; Mary Waithiegeni Chege, Zachariah Karenge Mungai and Ronald Ndirangu Ndegwa to be the Nairobi Metropolitan Area Transport Authority board, for three years, effective from February 10," read the notice signed by CS Macharia who also doubles up as the Nairobi Metropolitan Council chairman.

Macharia accused of perpetuating tribalism

The appointment had attracted a backlash from Kenyans who felt the CS disregarded the provision of inclusivity as enshrined in the 2010 constitution.

Agitated Kenyans trooped to social media to call out the CS for favouring his community in the appointments.

Law Society of Kenya (LSK) president Nelson Havi described the appointment of the three as "sinful" and one that depicts "moronic corruption."

Lawyer Donald Kipkorir, an ardent supporter of President Uhuru Kenyatta, called out Macharia for perpetuating tribalism in every public appointment he makes.

"I have to end my over two years restraining from commenting negatively about CS Macharia. As the minister of sprawling Transport, Infrastructure, Housing, Urban Development and Public Works, every time he makes an appointment, it has to be a Kikuyu. He is the worst tribalist," he tweeted.

Homa Bay Town MP Opondo Kaluma threatened to sponsor an impeachment motion against the CS over the appointment of the three members.

"This is stinking tribalism in a country where inclusivity is a constitutional ideal. A minister who makes such appointments should be nowhere around public service. I will bring a motion to remove James Macharia from office if he is not sacked," Kaluma said.
